{"id":6486,"date":"2026-02-09T13:11:19","date_gmt":"2026-02-09T12:11:19","guid":{"rendered":"https:\/\/gemap.es\/?p=6486"},"modified":"2026-02-16T11:21:49","modified_gmt":"2026-02-16T10:21:49","slug":"el-absentismo-vuelve-a-medirse-de-fecha-a-fecha","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/el-absentismo-vuelve-a-medirse-de-fecha-a-fecha\/","title":{"rendered":"L&#8217;absentisme es torna a mesurar de data a data"},"content":{"rendered":"\n<p>El Tribunal Suprem torna a posar ordre a una q\u00fcesti\u00f3 pr\u00e0ctica que genera conflictes recurrents en els <strong>acomiadaments disciplinaris per absentisme.<\/strong><\/p>\n\n\n\n<p>No tots els dubtes interpretatius es resolen a favor del treballador, i no tot mes equival al mes natural del calendari.<\/p>\n\n\n\n<p>La doctrina recent del Tribunal Suprem aclareix una q\u00fcesti\u00f3 que, a la pr\u00e0ctica di\u00e0ria dels despatxos, genera m\u00e9s conflictes dels que sembla: <strong>com s&#8217;ha de computar el per\u00edode mensual a qu\u00e8 es refereixen molts convenis col\u00b7lectius quan tipifiquen les faltes d&#8217;assist\u00e8ncia com a infracci\u00f3 molt greu.<\/strong><\/p>\n\n\n\n<p>El cas analitzat (sent\u00e8ncia de 19 de desembre de 2025) parteix d&#8217;una situaci\u00f3 aparentment senzilla -diverses abs\u00e8ncies injustificades repartides en diferents moments-, per\u00f2 desemboca en un debat jur\u00eddic de fons: el mes s&#8217;ha d&#8217;entendre com a mes natural o com un per\u00edode continuat de data a data?<\/p>\n\n\n\n<p>La resposta no \u00e9s neutra, i el Suprem ho deixa clar.<\/p>\n\n\n\n<p><strong>Atenci\u00f3<\/strong>. Un error al c\u00f2mput temporal pot convertir un acomiadament procedent en improcedent.<br><\/p>\n\n\n\n<p><strong>El sup\u00f2sit de fet: abs\u00e8ncies repartides i abandonament del lloc<\/strong><\/p>\n\n\n\n<p>La treballadora afectada no va acudir al seu lloc els dies 24 d&#8217;abril, 5 de maig, 16 de juny i 3 de juliol del 2023, ia m\u00e9s va abandonar el lloc el 8 de juny. El conveni col\u00b7lectiu aplicable qualificava com a falta molt greu faltar a la feina m\u00e9s de dos dies al mes sense causa justificada.<\/p>\n\n\n\n<p>L&#8217;empresa va optar per l?acomiadament disciplinari. El jutjat ho va declarar procedent. El Tribunal Superior de Just\u00edcia de Madrid, en canvi, va entendre que no se superava el llindar mensual si es computaven les abs\u00e8ncies per mesos naturals i va aplicar el principi in dubio pro operari.<\/p>\n\n\n\n<p>El Suprem corregeix aquesta interpretaci\u00f3.<\/p>\n\n\n\n<p>No n&#8217;hi ha prou de comptar dies: cal saber des d&#8217;on s&#8217;expliquen.<\/p>\n\n\n\n<p><strong>Qu\u00e8 ent\u00e9n el Tribunal Suprem per &#8220;mes&#8221; en aquests casos<\/strong><\/p>\n\n\n\n<p>L&#8217;Alt Tribunal recupera un criteri ja establert a la seva jurisprud\u00e8ncia, fins i tot quan estava vigent l&#8217;antic acomiadament objectiu per absentisme: els mesos s&#8217;han de computar de data a data, no per mesos naturals.<\/p>\n\n\n\n<p>Acceptar el criteri del calendari suposaria una evident distorsi\u00f3. Nom\u00e9s caldria que les abs\u00e8ncies es produ\u00efssin a final d&#8217;un mes ia principis del seg\u00fcent perqu\u00e8 algunes quedessin fora del c\u00f2mput, buidant de contingut la infracci\u00f3 prevista al conveni.<\/p>\n\n\n\n<p>A m\u00e9s, el Tribunal recorda que l&#8217;article 5 del Codi civil estableix que els terminis fixats per mesos es computen de data a data, i es tracta de terminis substantius, com passa a l&#8217;\u00e0mbit disciplinari.<\/p>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> El mes \u201claboral\u201d no sempre coincideix amb el mes del calendari.<br><\/p>\n\n\n\n<p><strong>Coher\u00e8ncia del sistema i rebuig dinterpretacions asistem\u00e0tiques<\/strong><\/p>\n\n\n\n<p>Un altre dels arguments clau \u00e9s la coher\u00e8ncia de l&#8217;ordenament. Apartar-se del c\u00f2mput de data a data implicaria trencar amb un criteri general consagrat a la llei, sense una ra\u00f3 s\u00f2lida que justifiqui aquesta excepci\u00f3.<\/p>\n\n\n\n<p>El Suprem subratlla que el conveni col\u00b7lectiu va ser negociat quan aquest criteri ja existia a la jurisprud\u00e8ncia. Si les parts haguessin volgut un c\u00f2mput diferent, ho podrien haver precisat expressament. No ho van fer.<\/p>\n\n\n\n<p>Per tant, la interpretaci\u00f3 ha de ser sistem\u00e0tica i no oportunista.<\/p>\n\n\n\n<p>El silenci del conveni no autoritza interpretacions for\u00e7ades.<\/p>\n\n\n\n<p><strong>El principi in dubio pro operari: quan s\u00ed i quan no<\/strong><\/p>\n\n\n\n<p>Un dels aspectes m\u00e9s rellevants de la sent\u00e8ncia \u00e9s el l\u00edmit clar al principi in dubio pro operari.<\/p>\n\n\n\n<p>El Tribunal recorda que aquest principi:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nom\u00e9s opera a la interpretaci\u00f3 del dret, no a la valoraci\u00f3 dels fets.<\/li>\n\n\n\n<li>\u00c9s un criteri de darrera r\u00e0tio, aplicable \u00fanicament quan, despr\u00e9s d&#8217;esgotar tots els m\u00e8todes interpretatius, subsisteix un dubte real.<\/li>\n<\/ul>\n\n\n\n<p>Aqu\u00ed no existia aquest dubte. El tenor literal del conveni, el context normatiu, larticle 5 del Codi Civil i la jurisprud\u00e8ncia pr\u00e8via condu\u00efen a una interpretaci\u00f3 clara.<\/p>\n\n\n\n<p>Aplicar el principi prooperari en aquest cas no sols era innecessari, sin\u00f3 improcedent.<\/p>\n\n\n\n<p>El principi pro operari no substitueix l&#8217;an\u00e0lisi jur\u00eddica rigorosa.<\/p>\n\n\n\n<p>Aplicant el c\u00f2mput de data a data, resulta indiscutit que la treballadora va superar el llindar d&#8217;abs\u00e8ncies previst com a falta molt greu al conveni col\u00b7lectiu.<\/p>\n\n\n\n<p>En conseq\u00fc\u00e8ncia, el Tribunal Suprem:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Casa i anul\u00b7la la sent\u00e8ncia del TSJ de Madrid,<\/li>\n\n\n\n<li>Confirma la del jutjat d&#8217;inst\u00e0ncia,<\/li>\n\n\n\n<li>I declara procedent l&#8217;acomiadament disciplinari.<\/li>\n<\/ul>\n\n\n\n<p>El criteri queda unificat i serveix de refer\u00e8ncia clara per a casos semblants.<\/p>\n\n\n\n<p>El c\u00e0lcul correcte del per\u00edode pot legitimar plenament la decisi\u00f3 empresarial.<\/p>\n\n\n\n<p><strong>Conclusi\u00f3<\/strong><\/p>\n\n\n\n<p>Aquesta sent\u00e8ncia refor\u00e7a un missatge clar: en mat\u00e8ria disciplin\u00e0ria, el temps es computa amb precisi\u00f3 jur\u00eddica, no pas amb intu\u00efcions de calendari.<\/p>\n\n\n\n<p>Per a les empreses, suposa m\u00e9s seguretat si el procediment est\u00e0 ben documentat, perqu\u00e8, com demostra aquest cas, un mes no sempre \u00e9s nom\u00e9s un mes.<\/p>\n\n\n\n<p>Abans de sancionar o d&#8217;impugnar, conv\u00e9 revisar com s&#8217;expliquen els dies.<\/p>\n\n\n\n<p>Pots contactar amb aquest despatx professional per a qualsevol dubte o aclariment que puguis tenir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El Tribunal Suprem torna a posar ordre a una q\u00fcesti\u00f3 pr\u00e0ctica que genera conflictes recurrents en els acomiadaments disciplinaris per absentisme.
