{"id":6435,"date":"2026-01-26T10:51:07","date_gmt":"2026-01-26T09:51:07","guid":{"rendered":"https:\/\/gemap.es\/?p=6435"},"modified":"2026-02-09T13:05:58","modified_gmt":"2026-02-09T12:05:58","slug":"la-proteccio-de-dades-en-les-relacions-laborals-criteris-clau-que-han-de-revisar-les-empreses","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/la-proteccio-de-dades-en-les-relacions-laborals-criteris-clau-que-han-de-revisar-les-empreses\/","title":{"rendered":"La protecci\u00f3 de dades en les relacions laborals: criteris clau que han de revisar les empreses"},"content":{"rendered":"\n<p>L&#8217;AEPD ha actualitzat la guia sobre protecci\u00f3 de dades en les relacions laborals, refor\u00e7ant criteris que moltes empreses donen per assumits, per\u00f2 que segueixen generant errors freq\u00fcents a la pr\u00e0ctica di\u00e0ria.<\/p>\n\n\n\n<p>L&#8217;Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD) ha publicat al web la guia actualitzada <a href=\"http:\/\/chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/\/www.aepd.es\/guias\/la-proteccion-de-datos-en-las-relaciones-laborales.pdf\">\u00abLa protecci\u00f3 de dades en les relacions laborals\u00bb<\/a>, un document extens i d&#8217;orientaci\u00f3 pr\u00e0ctica que revisa com s&#8217;ha d&#8217;aplicar el RGPD i la LOPDGDD en totes les fases de la relaci\u00f3 laboral, des de la selecci\u00f3 fins a l&#8217;extinci\u00f3 del contracte, passant pel control empresarial, la vigil\u00e0ncia de la salut.<\/p>\n\n\n\n<p>No \u00e9s una norma nova, per\u00f2 s\u00ed un document de refer\u00e8ncia clara per a l&#8217;AEPD, que consolida criteris, adverteix de males pr\u00e0ctiques freq\u00fcents i anticipa l&#8217;enfocament que se seguir\u00e0 en actuacions inspectores i procediments sancionadors.<\/p>\n\n\n\n<p>A continuaci\u00f3, els resumim els aspectes m\u00e9s rellevants.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Principis generals que han de guiar qualsevol tractament de dades laborals<\/strong><\/li>\n<\/ol>\n\n\n\n<p>L&#8217;AEPD recorda que la dada personal a l&#8217;\u00e0mbit laboral \u00e9s un concepte ampli, que inclou no nom\u00e9s dades identificatives, sin\u00f3 tamb\u00e9 valoracions, avaluacions d&#8217;acompliment, registres interns, imatges, \u00e0udios o informaci\u00f3 inferida.<\/p>\n\n\n\n<p>Punts clau:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El consentiment del treballador poques vegades \u00e9s una base jur\u00eddica v\u00e0lida, pel desequilibri existent en la relaci\u00f3 laboral.<\/li>\n\n\n\n<li>La base principal del tractament sol ser:\n<ul class=\"wp-block-list\">\n<li>L&#8217;execuci\u00f3 del contracte de treball, o<\/li>\n\n\n\n<li>El compliment duna obligaci\u00f3 legal.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>L&#8217;inter\u00e8s leg\u00edtim empresarial nom\u00e9s \u00e9s v\u00e0lid si supera un judici estricte de proporcionalitat.<\/li>\n\n\n\n<li>Es refor\u00e7a el principi de minimitzaci\u00f3: no tot all\u00f2 que resulta \u00fatil per a l&#8217;empresa \u00e9s necessari des del punt de vista legal.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>Molts incompliments no deriven de grans sistemes tecnol\u00f2gics, sin\u00f3 de la recollida excessiva de dades \u00abper si de cas\u00bb.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Informaci\u00f3 i transpar\u00e8ncia: no n&#8217;hi ha prou amb incloure una cl\u00e0usula gen\u00e8rica<\/strong><\/li>\n<\/ol>\n\n\n\n<p>La guia insisteix que el deure informaci\u00f3 forma part essencial del dret fonamental a la protecci\u00f3 de dades.<\/p>\n\n\n\n<p>Aspectes rellevants:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La informaci\u00f3 ha de ser clara, entenedora i no excessivament t\u00e8cnica.<\/li>\n\n\n\n<li>\u00c9s recomanable el model dinformaci\u00f3 per capes.<\/li>\n\n\n\n<li>S&#8217;ha d&#8217;informar:\n<ul class=\"wp-block-list\">\n<li>En el moment de la recollida de dades, o<\/li>\n\n\n\n<li>En un termini m\u00e0xim dun mes si les dades no procedeixen directament del treballador.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Incloure una cl\u00e0usula informativa al contracte no equival a obtenir consentiment.<\/li>\n<\/ul>\n\n\n\n<p>Atenci\u00f3. Moltes empreses confonen informar de legitimar el tractament. S\u00f3n plans diferents.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Drets de les persones treballadores: especial atenci\u00f3 a l&#8217;acc\u00e9s i la supressi\u00f3<\/strong><\/li>\n<\/ol>\n\n\n\n<p>L&#8217;AEPD dedica un bloc ampli als drets ARSULIPO (acc\u00e9s, rectificaci\u00f3, supressi\u00f3, limitaci\u00f3, portabilitat i oposici\u00f3).<\/p>\n\n\n\n<p>Punts especialment sensibles:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El dret dacc\u00e9s inclou avaluacions, informes interns i valoracions.<\/li>\n\n\n\n<li>La supressi\u00f3 no implica esborrament immediat: abans s&#8217;ha de produir el bloqueig de les dades quan hi hagi obligaci\u00f3 legal de conservaci\u00f3.<\/li>\n\n\n\n<li>El bloqueig exigeix \u200b\u200bmesures t\u00e8cniques reals que impedeixin l\u00fas de la dada.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3<\/strong>. Eliminar dades sense bloquejar-les pr\u00e8viament pot ser tan incorrecte com conservar-les indefinidament.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Selecci\u00f3 i contractaci\u00f3: l\u00edmits clars a preguntes, xarxes socials i vida laboral<\/strong><\/li>\n<\/ol>\n\n\n\n<p>En els processos de selecci\u00f3, l&#8217;AEPD refor\u00e7a criteris ja coneguts, per\u00f2 sovint incomplerts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nom\u00e9s es poden sol\u00b7licitar dades rellevants per al lloc.<\/li>\n\n\n\n<li>No \u00e9s l\u00edcit investigar xarxes socials, encara que els perfils siguin p\u00fablics, llevat que hi hagi justificaci\u00f3 objectiva i se n&#8217;hagi informat pr\u00e8viament.<\/li>\n\n\n\n<li>No es poden formular preguntes personals, familiars o m\u00e8diques alienes al lloc.<\/li>\n\n\n\n<li>La sol\u00b7licitud de l&#8217;informe de vida laboral nom\u00e9s \u00e9s admissible sota un inter\u00e8s leg\u00edtim ben delimitat i amb un abast m\u00ednim.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3<\/strong>. Moltes reclamacions s&#8217;originen en entrevistes mal plantejades, no al contracte.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Desenvolupament de la relaci\u00f3 laboral: n\u00f2mines, productivitat i den\u00fancies internes<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Durant la relaci\u00f3 laboral, la guia aborda q\u00fcestions d&#8217;alt impacte pr\u00e0ctic:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Publicaci\u00f3 de dades de productivitat: nom\u00e9s quan sigui estrictament necessari.<\/li>\n\n\n\n<li>N\u00f2mines: especial cura amb accessos interns i enviaments erronis.<\/li>\n\n\n\n<li>Sistemes de den\u00fancies internes (whistleblowing):\n<ul class=\"wp-block-list\">\n<li>Acc\u00e9s restringit,<\/li>\n\n\n\n<li>Confidencialitat refor\u00e7ada,<\/li>\n\n\n\n<li>Terminis de conservaci\u00f3 molt concrets.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> L&#8217;acc\u00e9s intern indegut a les dades laborals \u00e9s una de les infraccions m\u00e9s habituals.<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li><strong>Control de l&#8217;activitat laboral: videovigil\u00e0ncia, geolocalitzaci\u00f3 i detectius<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Aquest \u00e9s un dels blocs m\u00e9s sensibles de la guia.<\/p>\n\n\n\n<p>Criteris clau:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El control empresarial \u00e9s leg\u00edtim, per\u00f2 no il\u00b7limitat.<\/li>\n\n\n\n<li>Videovigil\u00e0ncia:\n<ul class=\"wp-block-list\">\n<li>Prohibida en zones sensibles (lavabos, vestuaris),<\/li>\n\n\n\n<li>Requereix informaci\u00f3 pr\u00e8via clara.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Geolocalitzaci\u00f3\n<ul class=\"wp-block-list\">\n<li>Nom\u00e9s durant la jornada,<\/li>\n\n\n\n<li>Amb finalitat concreta i proporcional.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Admissibles nom\u00e9s com a mesura excepcional i proporcionada.<\/li>\n\n\n\n<li>Detectius privats<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3<\/strong>. El problema no sol ser el sistema, sin\u00f3 l&#8217;exc\u00e9s en el seu \u00fas.<\/p>\n\n\n\n<ol start=\"7\" class=\"wp-block-list\">\n<li><strong>Representaci\u00f3 legal i sindical: cessions i publicacions de dades<\/strong><\/li>\n<\/ol>\n\n\n\n<p>L&#8217;AEPD recorda que els representants de les persones treballadores:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Poden accedir a dades nom\u00e9s quan hi hagi habilitaci\u00f3 legal,<\/li>\n\n\n\n<li>Han de respectar els mateixos principis de confidencialitat i minimitzaci\u00f3,<\/li>\n\n\n\n<li>No poden publicar dades personals indiscriminadament a taulers o comunicacions.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>La condici\u00f3 de representant no eximeix del compliment del RGPD.<\/p>\n\n\n\n<ol start=\"8\" class=\"wp-block-list\">\n<li><strong>Vigil\u00e0ncia de la salut i dades m\u00e8diques: especial protecci\u00f3<\/strong><\/li>\n<\/ol>\n\n\n\n<p>La guia dedica un bloc complet a les dades de salut, considerades categoria especial:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;acc\u00e9s de lempresa ha de limitar-se a conclusions daptitud.<\/li>\n\n\n\n<li>Les hist\u00f2ries cl\u00edniques no s\u00f3n accessibles a l&#8217;empresa.<\/li>\n\n\n\n<li>Wearables i noves tecnologies exigeixen avaluaci\u00f3 dimpacte previ.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>Qualsevol filtraci\u00f3 de dades de salut t\u00e9 un risc sancionador molt elevat.<\/p>\n\n\n\n<p><em>La publicaci\u00f3 de l&#8217;AEPD no introdueix obligacions noves, per\u00f2 s\u00ed que consolida criteris que ja s&#8217;estan aplicant en inspeccions i sancions.
