{"id":6384,"date":"2026-01-19T13:06:30","date_gmt":"2026-01-19T12:06:30","guid":{"rendered":"https:\/\/gemap.es\/?p=6384"},"modified":"2026-01-19T13:06:31","modified_gmt":"2026-01-19T12:06:31","slug":"ladaptacio-de-jornada-no-es-denega-sense-mes-ni-mes","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/ladaptacio-de-jornada-no-es-denega-sense-mes-ni-mes\/","title":{"rendered":"L&#8217;adaptaci\u00f3 de jornada no es \u201cdenega\u201d sense m\u00e9s ni m\u00e9s"},"content":{"rendered":"\n<p>Hi ha decisions que no fallen pel \u201cqu\u00e8\u201d, sin\u00f3 pel \u201ccom\u201d.<\/p>\n\n\n\n<p>I en conciliaci\u00f3, el Tribunal Suprem acaba de recordar-ho amb for\u00e7a contund\u00e8ncia: <strong>Si una treballador\/a demana adaptar la seva jornada per conciliaci\u00f3, l&#8217;empresa pot no estar-hi d&#8217;acord, per\u00f2 ja no pot despatxar-ho amb una negativa directa sense m\u00e9s recorregut.<\/strong><\/p>\n\n\n\n<p>En mat\u00e8ria de conciliaci\u00f3 laboral, moltes vegades el problema no \u00e9s que una empresa digui &#8220;no&#8221;, sin\u00f3 en com arriba a aquest &#8220;no&#8221;.<\/p>\n\n\n\n<p>El Tribunal Suprem (TS) ha recordat una cosa molt pr\u00e0ctica: quan una persona demana adaptar la seva jornada per necessitats familiars, l&#8217;empresa no es pot limitar a denegar i girar full. Abans heu d&#8217;obrir un espai de negociaci\u00f3 real, encara que sigui breu, per intentar encaixar la petici\u00f3 o plantejar alternatives.<\/p>\n\n\n\n<p>I per qu\u00e8 aix\u00f2 importa tant? Perqu\u00e8 si aquest pas s&#8217;omet, el conflicte ja no es discuteix en igualtat de condicions: el procediment es converteix en el centre de l&#8217;assumpte i el jutge pot inclinar la balan\u00e7a a favor de la persona treballadora.<\/p>\n\n\n\n<p>La Sent\u00e8ncia 825\/2025 del TS \u00e9s un bon exemple d&#8217;aquesta idea: no s&#8217;est\u00e0 dient que tot s&#8217;hagi de concedir sempre, sin\u00f3 que saltar-se la negociaci\u00f3 pot sortir car, fins i tot quan l&#8217;organitzaci\u00f3 cregui que t\u00e9 raons.<\/p>\n\n\n\n<p>La sent\u00e8ncia aborda un escenari molt com\u00fa: una persona treballadora sol\u00b7licita una adaptaci\u00f3 de jornada per conciliaci\u00f3 a l&#8217;empara de l&#8217;art. 34.8 de lEstatut dels Treballadors (ET, redacci\u00f3 introdu\u00efda pel RDL 6\/2019) i lempresa respon denegant, sense obrir el tr\u00e0mit de negociaci\u00f3 individual que preveu la norma quan no hi ha regulaci\u00f3 espec\u00edfica en conveni.<\/p>\n\n\n\n<p>El Suprem ve a dir, sense embuts: aquest tr\u00e0mit de negociaci\u00f3 no \u00e9s decoratiu. \u00c9s una pe\u00e7a essencial del dret; si l&#8217;empresa s&#8217;ho salta, el plet es juga costa amunt.<\/p>\n\n\n\n<p><strong>La idea clau que fixa doctrina<\/strong><\/p>\n\n\n\n<p>El nucli del criteri \u00e9s aquest: si l&#8217;empresa no obre el proc\u00e9s negociador, la sent\u00e8ncia ha d&#8217;estimar la sol\u00b7licitud en els termes demanats per la persona treballadora, llevat que el jutjat vegi que all\u00f2 sol\u00b7licitat \u00e9s manifestament irraonable o desproporcionat.<\/p>\n\n\n\n<p>Dit en llenguatge pla: si no hi ha negociaci\u00f3, el jutge tendeix a &#8220;reparar&#8221; el dret concedint el que s&#8217;ha demanat, llevat que sigui un disbarat evident.<\/p>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> No n&#8217;hi ha prou de denegar &#8220;amb raons&#8221; si abans no s&#8217;ha passat per la negociaci\u00f3 real. La motivaci\u00f3, per si sola, pot arribar tard.<br><\/p>\n\n\n\n<p><strong>Qu\u00e8 s&#8217;ent\u00e9n per \u201cnegociar\u201d de deb\u00f2?<\/strong><\/p>\n\n\n\n<p>Negociar aqu\u00ed no \u00e9s un correu de dues l\u00ednies ni una conversa de passad\u00eds. El Suprem el tracta com una negociaci\u00f3 aut\u00e8ntica, amb intercanvi de posicions i cerca de puntes: propostes, contrapropostes, alternatives raonables, i tot aix\u00f2 dins del marc temporal legal.<\/p>\n\n\n\n<p>Tamb\u00e9 deixa caure una cosa important: si l&#8217;empresa accepta d&#8217;entrada perfecte; aqu\u00ed la negociaci\u00f3 &#8220;es consumeix&#8221; perqu\u00e8 ja hi ha acord. Per\u00f2 si negar\u00e0 o proposar\u00e0 una altra cosa, ha d&#8217;existir aquest proc\u00e9s previ.<\/p>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>Si l&#8217;empresa diu &#8220;s\u00ed que hi va haver reunions&#8221;, per\u00f2 no ho pot acreditar amb m\u00ednims (actes, correus, propostes), a sala aix\u00f2 sol quedar en res.<br><\/p>\n\n\n\n<p><strong>L&#8217;excepci\u00f3 que pot salvar una denegaci\u00f3<\/strong><\/p>\n\n\n\n<p>La sent\u00e8ncia no converteix l&#8217;adaptaci\u00f3 en un \u201cdret autom\u00e0tic\u201d sempre. La porta que queda oberta \u00e9s clara: el jutge pot no concedir-ho si all\u00f2 demanat resulta manifestament (atenci\u00f3 a la paraula) irraonable o desproporcionat.<\/p>\n\n\n\n<p>Aix\u00f2 col\u00b7loca el llist\u00f3 alt: no val que &#8220;compliqui&#8221;, &#8220;incomodi&#8221; o &#8220;no agradi&#8221;. Hi ha d&#8217;haver una manca de proporci\u00f3 evident, o un impacte organitzatiu molt dif\u00edcil de sostenir\u2026 i, tot i aix\u00ed, el m\u00e9s assenyat \u00e9s haver negociat i haver intentat alternatives abans.<\/p>\n\n\n\n<p>L&#8217;empresa sol perdre credibilitat quan la primera reacci\u00f3 \u00e9s el &#8220;no&#8221; i l&#8217;alternativa apareix nom\u00e9s quan ja hi ha demanda.<\/p>\n\n\n\n<p><strong>Connexi\u00f3 amb la redacci\u00f3 actual de lart. 34.8 ET<\/strong><\/p>\n\n\n\n<p>Tot i que el cas s&#8217;analitza amb la redacci\u00f3 aplicable del RDL 6\/2019, cal no oblidar que l&#8217;art. 34.8 s&#8217;ha continuat movent, i avui la norma refor\u00e7a la idea de rapidesa i resposta motivada en terminis m\u00e9s curts (a la pr\u00e0ctica, aix\u00f2 ha emp\u00e8s moltes empreses a formalitzar millor el proc\u00e9s).<\/p>\n\n\n\n<p>Traducci\u00f3 pr\u00e0ctica: si ja era perill\u00f3s improvisar, ara ho \u00e9s m\u00e9s.<\/p>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> No tenir un \u201ccircuit intern\u201d (RR. HH., comandament, legal, terminis, documentaci\u00f3) converteix cada sol\u00b7licitud en una urg\u00e8ncia mal gestionada.<br><\/p>\n\n\n\n<p><strong>Qu\u00e8 implica per a empreses i Recursos Humans?<\/strong><\/p>\n\n\n\n<p>Per evitar que un conflicte es decideixi per un &#8220;pas om\u00e8s&#8221;, conv\u00e9 actuar amb m\u00e8tode:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acusament de rebut per escrit i data clara.<\/li>\n\n\n\n<li>Obertura formal del proc\u00e9s negociador (calendari, reunions, interlocutors).<\/li>\n\n\n\n<li>Intercanvi real: qu\u00e8 demana la persona, quines necessitats hi ha, quines alternatives hi ha.<\/li>\n\n\n\n<li>Proposta alternativa si no hi encaixa (no val una alternativa impossible o cosm\u00e8tica).<\/li>\n\n\n\n<li>Decisi\u00f3 final escrita i motivada, amb raons objectives i, si escau, proves o dades (quadrants, pics de producci\u00f3, torns, cobertura, etc.).<\/li>\n<\/ul>\n\n\n\n<p>El que m\u00e9s penalitza el Suprem no \u00e9s discrepar, sin\u00f3 no haver intentat l&#8217;encaix quan la llei obliga a intentar-lo <\/p>\n\n\n\n<p>Si voleu una regla r\u00e0pida per al dia a dia: <strong>&#8220;Primer negoci, despr\u00e9s decideixo.&#8221;<\/strong><\/p>\n\n\n\n<p>Si es comen\u00e7a per decidir, el procediment queda coix i el judici es pot resoldre per aquest flanc.
