De vegades el problema no \u00e9s el perm\u00eds en si, sin\u00f3 com s&#8217;acredita.<\/p>\n\n\n\n<p>La llei demana \u201cjustificaci\u00f3 oportuna\u201d, per\u00f2 no sempre \u00e9s clar qu\u00e8 significa aix\u00f2. Ho expliquem de manera senzilla.<\/p>\n\n\n\n<p>Vol\u00edem comentar-los un tema que sol donar m\u00e9s d&#8217;un maldecap a les empreses i que, \u00faltimament, est\u00e0 generant for\u00e7a consultes: els permisos per hospitalitzaci\u00f3 d&#8217;un familiar.<\/p>\n\n\n\n<p>El cas \u00e9s el de sempre, un treballador demana cinc (5) dies perqu\u00e8 un familiar est\u00e0 ingressat, per\u00f2 l&#8217;ingr\u00e9s no dura tant o se sospita que potser no \u00e9s tan perllongat. I aqu\u00ed arriba el dubte raonable: l&#8217;empresa pot demanar-li que ho justifiqui? Qu\u00e8 passa si no lliura cap document? La resposta, com gaireb\u00e9 tot en mat\u00e8ria laboral, dep\u00e8n dels matisos.<\/p>\n\n\n\n<p>L&#8217;Estatut dels Treballadors (ET), a l&#8217;article 37, diu que l&#8217;empleat t\u00e9 dret a 5 dies retribu\u00efts quan hi ha hospitalitzaci\u00f3 o intervenci\u00f3 quir\u00fargica sense hospitalitzaci\u00f3 que requereixi rep\u00f2s domiciliari del seu c\u00f2njuge, parella de fet, parents fins a segon grau (consanguinitat o afinitat), o d&#8217;una persona que convisqui amb cura.<\/p>\n\n\n\n<p>Fins aqu\u00ed tot \u00e9s clar. Per\u00f2 la clau \u00e9s que la llei exigeix \u200b\u200bav\u00eds i justificaci\u00f3. I aix\u00f2 vol dir que el treballador ha d&#8217;acreditar que el fet causant realment existeix.<\/p>\n\n\n\n<p>Per tant, lempresa pot demanar un justificant. No es tracta de desconfiar, sin\u00f3 de complir el procediment. Si l&#8217;empleat no ho acredita, l&#8217;abs\u00e8ncia es pot considerar no justificada, amb les conseq\u00fc\u00e8ncies que prevegi el conveni (falta lleu, greu o molt greu, segons el cas).<\/p>\n\n\n\n<p>Documentaci\u00f3. No cal una paperassa excessiva. \u00c9s l\u00f2gic demanar una cosa que acrediti la situaci\u00f3: un informe o part d&#8217;hospitalitzaci\u00f3, o un document m\u00e8dic on consti la data d&#8217;ingr\u00e9s i, si escau, la necessitat de rep\u00f2s domiciliari. Tamb\u00e9 es pot demanar una cosa que acrediti l&#8217;enlla\u00e7 familiar si no \u00e9s evident. El que no es pot fer \u00e9s exigir documents o certificats que vagin m\u00e9s enll\u00e0 del que estableix la llei o conveni. Si el conveni nom\u00e9s diu \u201cjustificaci\u00f3 oportuna\u201d, no podem imposar models o certificats oficials.<\/p>\n\n\n\n<p>Quan s&#8217;acaba el perm\u00eds?<br>Aqu\u00ed ve un altre dubte habitual. El perm\u00eds dura 5 dies h\u00e0bils, per\u00f2 no necess\u00e0riament es gaudeixen complets si lhospitalitzaci\u00f3 acaba abans. Si el familiar rep l&#8217;alta al tercer dia i no necessita rep\u00f2s, el perm\u00eds s&#8217;acaba. En canvi, si segueix a casa i requereix cura, el treballador pot esgotar els cinc dies, sempre que ho acrediti. \u00c9s recomanable demanar tamb\u00e9 l&#8217;informe d&#8217;alta hospital\u00e0ria, on consti si hi ha rep\u00f2s domiciliari o no. Aix\u00f2 evita malentesos i possibles conflictes.<\/p>\n\n\n\n<p>El Tribunal Suprem ha aclarit que els permisos retribu\u00efts \u2013com aquest\u2013 s&#8217;han de gaudir en dies laborables, no naturals. I que el c\u00f2mput comen\u00e7a el primer dia feiner posterior al fet causant. T\u00e9 l\u00f2gica: el perm\u00eds nom\u00e9s t\u00e9 sentit quan cal anar a la feina.<\/p>\n\n\n\n<p>Per tant, si l&#8217;ingr\u00e9s va ser un diumenge, el perm\u00eds es comen\u00e7ar\u00e0 a comptar dilluns (o el primer dia que el treballador hagu\u00e9s de treballar).<\/p>\n\n\n\n<p>Des de la nostra experi\u00e8ncia, el m\u00e9s assenyat en aquests casos \u00e9s actuar amb equilibri. Demanar la documentaci\u00f3, s\u00ed, per\u00f2 amb tacte. Un simple justificant m\u00e8dic i la data de l&#8217;ingr\u00e9s s\u00f3n suficients. Si el treballador actua de bona fe, no hi ha cap motiu per dubtar.<\/p>\n\n\n\n<p>Aix\u00f2 s\u00ed, si no lliura cap document ni acredita res, l&#8217;empresa el pot tractar com a abs\u00e8ncia injustificada. Conv\u00e9 deixar-ho reflectit per escrit i comunicar-li formalment que s&#8217;ha de reincorporar quan deixi d&#8217;existir la causa del perm\u00eds.<\/p>\n\n\n\n<p>En aquests sup\u00f2sits, el que \u00e9s important \u00e9s documentar b\u00e9: sol\u00b7licitud, resposta de l&#8217;empresa i justificants. Aix\u00ed, s&#8217;evita que una situaci\u00f3 sensible acabi en conflicte disciplinari.<\/p>\n\n\n\n<p>En tot cas, el nostre despatx els pot ajudar a revisar com gestionar aquests permisos, preparar un model de sol\u00b7licitud i deixar clares les regles al reglament intern o als protocols de RRHH.
