Avui algunes empreses volen recuperar la presencialitat. La pregunta clau: es pot imposar el retorn si hi ha un acord de teletreball vigent? La resposta curta \u00e9s no, unilateralment no.<\/p>\n\n\n\n<p>La Llei 10\/2021, de treball a dist\u00e0ncia, \u00e9s contundent: el teletreball \u00e9s voluntari per a ambdues parts i exigeix \u200b\u200bacord per escrit; no es pot imposar (ni suprimir-ho) usant l&#8217;art. 41 ET (modificaci\u00f3 substancial). A m\u00e9s, la reversibilitat existeix, per\u00f2 en els termes fixats per la negociaci\u00f3 col\u00b7lectiva o pel propi acord, no a larbitri duna de les parts.<\/p>\n\n\n\n<p>Atenci\u00f3. Si hi ha un acord de treball a dist\u00e0ncia i no hi ha cl\u00e0usula de reversi\u00f3 v\u00e0lida o consentiment del treballador, no es pot imposar el retorn &#8220;perqu\u00e8 s\u00ed&#8221;. Qualsevol canvi exigeix \u200b\u200bun nou acord escrit abans d&#8217;aplicar-s&#8217;hi.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Marc legal en dos tra\u00e7os<\/h2>\n\n\n\n<p>Voluntarietat i acord escrit. El teletreball es pacta; no s&#8217;imposa ni es retira autom\u00e0ticament. Reversibilitat: s\u00ed, per\u00f2 segons el que s&#8217;ha pactat o el que preveu el conveni.<br>Contingut m\u00ednim i notificacions. L&#8217;acord ha d&#8217;incloure contingut m\u00ednim i comunicar-se a la RLT\/Oficina d&#8217;ocupaci\u00f3 quan escaigui.<br>L\u00edmits a cl\u00e0usules abusives. L&#8217;Audi\u00e8ncia Nacional ha anul\u00b7lat cl\u00e0usules gen\u00e8riques o desequilibrades en acords de teletreball (per exemple, imposar mitjans personals o deixar la reversi\u00f3 al sol criteri empresarial).<br>Jurisprud\u00e8ncia recent. S&#8217;estan corregint cl\u00e0usules de retorn r\u00edgides i limitacions de despeses a grans empreses (cas Endesa), recordant que no cal modificar unilateralment i que les despeses de remot s&#8217;han de tractar d&#8217;acord amb la llei.<br><strong>Atenci\u00f3<\/strong>. No feu servir l&#8217;art. 41 ET per &#8220;convertir&#8221; teletreball en presencial sense la via pactada: la mateixa Llei 10\/2021 ho prohibeix expressament.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quan es pot revertir el teletreball?<\/h2>\n\n\n\n<p>Per pacte entre empresa i treballador (nou acord escrit).<br>Perqu\u00e8 ho permeti el conveni amb condicions clares (terminis, causes, forma i garanties).<br>Cl\u00e0usula de reversibilitat en el propi acord ben redactada, amb causes taxades, preav\u00eds i procediment (no n&#8217;hi ha prou amb \u201cper necessitats organitzatives\u201d sense concreci\u00f3).<br><strong>Atenci\u00f3.<\/strong> Les cl\u00e0usules gen\u00e8riques (&#8220;l&#8217;empresa decidir\u00e0 la tornada per necessitats internes&#8221;) s&#8217;estan anul\u00b7lant: deixen el contracte a l&#8217;arbitri d&#8217;una banda i vulneren la normativa de treball a dist\u00e0ncia.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Procediment recomanat si voleu recuperar presencialitat<\/h2>\n\n\n\n<p>Auditeu els acords vigents: qu\u00e8 diuen sobre reversibilitat, preavisos, despeses, equips i lloc de treball.<br>Verifiqueu si el conveni regula retorn i en quins termes.<br>Prepareu proposta amb causes concretes (ETOP), cronograma, preavisos i, si escau, mesures de transici\u00f3 (mixt, formaci\u00f3, suport a mobilitat).<br>Negocieu amb la RLT (o amb les persones treballadores si no hi ha RLT) i documenteu tot el proc\u00e9s.<br>Formalitzeu per escrit els nous acords abans d&#8217;aplicar canvis.<br>Comuniqueu i acompanyeu: ajustament de llocs, ergonomia, ciberseguretat, registre horari i canals de suport.<br><strong>Atenci\u00f3.<\/strong> No deixeu v\u00e8ncer acords o p\u00f2lisses associades al remot sense pla de transici\u00f3: apagades contractuals generen risc jur\u00eddic i queixes internes.<\/p>\n\n\n\n<p>Portar de tornada a l&#8217;oficina amb acord de teletreball vigent no \u00e9s un tr\u00e0mit, \u00e9s un proc\u00e9s: pacte, claredat i m\u00e8tode. La llei protegeix la voluntarietat i els tribunals invaliden dreceres i cl\u00e0usules imprecises.
