Una sent\u00e8ncia recent del Suprem posa fi a una pr\u00e0ctica injusta i massa habitual: negar als treballadors cedits el complement salarial per IT previst al conveni de l&#8217;empresa usu\u00e0ria.<\/p>\n\n\n\n<p>Teniu a la vostra empresa treballadors contractats a trav\u00e9s d&#8217;una ETT? Sabia que, si es posen de baixa, tamb\u00e9 pot estar obligat a pagar-los les millores volunt\u00e0ries previstes al seu conveni col\u00b7lectiu, fins i tot encara que no formin part directament de la seva plantilla?<\/p>\n\n\n\n<p>Doncs b\u00e9, aix\u00f2 ja no \u00e9s una q\u00fcesti\u00f3 oberta a interpretaci\u00f3. El Tribunal Suprem, en la Sent\u00e8ncia 466\/2025, de 27 de maig, ho ha deixat clar: el personal cedit t\u00e9 dret a percebre les millores econ\u00f2miques per incapacitat temporal previstes en el conveni de l&#8217;empresa usu\u00e0ria.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 ha dit exactament el Suprem?<\/h2>\n\n\n\n<p>A partir d&#8217;ara, cal entendre que el concepte de \u00abremuneraci\u00f3\u00bb de l&#8217;article 11 de la Llei 14\/1994 sobre empreses de treball temporal tamb\u00e9 inclou les millores volunt\u00e0ries per incapacitat temporal, i no nom\u00e9s el salari base o complements per conveni.<\/p>\n\n\n\n<p>Aquest canvi es basa en:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La interpretaci\u00f3 del Tribunal de Just\u00edcia de la UE (TJUE) a la sent\u00e8ncia C-649\/2022, de 22 de febrer de 2024.<\/li>\n\n\n\n<li>El principi d&#8217;igualtat de tracte previst tant a la normativa espanyola com a la Directiva 2008\/104\/CE.<\/li>\n\n\n\n<li>I el fet innegable que si el treballador hagu\u00e9s estat contractat directament per l&#8217;empresa usu\u00e0ria hauria cobrat aquest complement sense discussi\u00f3.<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>Si teniu personal d&#8217;ETT i el vostre conveni col\u00b7lectiu preveu un complement durant les baixes m\u00e8diques, caldr\u00e0 aplicar-lo tamb\u00e9 a aquests treballadors. No fer-ho podria acabar en una reclamaci\u00f3 amb condemna.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 implica per a les empreses usu\u00e0ries?<\/h2>\n\n\n\n<p>Aquest criteri t\u00e9 efectes immediats a tots els contractes de posada a disposici\u00f3 actuals i futurs. Si est\u00e0s recorrent a personal extern mitjan\u00e7ant ETT, haur\u00e0s de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Revisar si el teu conveni col\u00b7lectiu inclou millores econ\u00f2miques en cas de baixa (per exemple, complement fins al 100% del salari durant una IT).<\/li>\n\n\n\n<li>Verificar si aquests complements tamb\u00e9 s&#8217;estan aplicant al personal cedit per ETT.<\/li>\n\n\n\n<li>En cas negatiu, corregir aquesta situaci\u00f3 o podries enfrontar-te a reclamacions de quantitat i fins i tot sancions.<\/li>\n<\/ul>\n\n\n\n<p>A m\u00e9s, aquesta doctrina no fa distinci\u00f3 entre incapacitat temporal o permanent, ja que en tots dos casos la finalitat \u00e9s la mateixa: compensar la p\u00e8rdua dingressos del treballador.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I si el conveni aplicable a l&#8217;ETT \u00e9s diferent?<\/h2>\n\n\n\n<p>Aquest \u00e9s un dels punts clau de la sent\u00e8ncia. Tot i que el contracte amb l&#8217;ETT indiqui que es regeix pel conveni del sector d&#8217;ETT, aix\u00f2 no exclou l&#8217;aplicaci\u00f3 de les condicions m\u00e9s beneficioses del conveni de l&#8217;empresa usu\u00e0ria, en tot all\u00f2 que afecti les anomenades condicions essencials de treball i ocupaci\u00f3, com la remuneraci\u00f3 en situaci\u00f3 de baixa.<\/p>\n\n\n\n<p>La igualtat de tracte no \u00e9s negociable, ni es pot eludir amb cl\u00e0usules contractuals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Recomanacions pr\u00e0ctiques<\/h4>\n\n\n\n<p>Des de la nostra assessoria, us aconsellem que:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reviseu urgentment les condicions que apliqueu a treballadors d&#8217;ETT.<\/li>\n\n\n\n<li>Verifiqueu si els vostres convenis inclouen complements per incapacitat temporal.<\/li>\n\n\n\n<li>Ajusteu les vostres pol\u00edtiques de retribuci\u00f3 en cas de baixa m\u00e8dica per a personal cedit.<\/li>\n\n\n\n<li>Documenteu correctament aquests pagaments per evitar reclamacions retroactives.<\/li>\n<\/ul>\n\n\n\n<p>Atenci\u00f3. Aquesta interpretaci\u00f3 ja \u00e9s doctrina consolidada del Tribunal Suprem.
