Compte, aix\u00f2 es considera un canvi important i cal negociar-lo legalment.<\/p>\n\n\n\n<p>Una sent\u00e8ncia recent del Tribunal Suprem de 4 d&#8217;abril del 2025 ha confirmat una cosa molt important: <strong>no pot canviar la jornada laboral sense negociar amb els treballadors si ja s&#8217;havia consolidat un altre horari.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El cas que ho canvia tot<\/h2>\n\n\n\n<p>Una empresa del sector serveis tenia la plantilla contractada amb jornada de dilluns a diumenge, per\u00f2 des de feia anys treballaven nom\u00e9s de dilluns a divendres. El 2022, l&#8217;empresa va decidir tornar a aplicar la jornada completa de dilluns a diumenge, al\u00b7legant que aix\u00f2 deia el contracte i ho exigia el client.<\/p>\n\n\n\n<p>Qu\u00e8 va dir el Tribunal Suprem? Que aquest canvi no es podia fer sense passar pel procediment de l&#8217;article 41 de l&#8217;Estatut dels Treballadors, perqu\u00e8 ja s&#8217;havia consolidat una jornada diferent, encara que el contracte digu\u00e9s una altra cosa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quan est\u00e0 fent una \u201cmodificaci\u00f3 substancial\u201d?<\/h2>\n\n\n\n<p>Si canvia:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&#8217;horari o els dies de feina habituals (per exemple, passar de dilluns a divendres a dilluns a diumenge).<\/li>\n\n\n\n<li>La jornada (reduir-la, ampliar-la, canviar-la de mat\u00ed a tarda, etc.).<\/li>\n\n\n\n<li>El lloc de treball habitual o el sistema de treball (presencial\/remoto, per exemple).<\/li>\n<\/ul>\n\n\n\n<p>Encara que el contracte digui alguna cosa, si fa anys que funciona d&#8217;una altra manera, el canvi s&#8217;ha de negociar amb els treballadors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 passa si no segueixes el procediment?<\/h2>\n\n\n\n<p>El canvi es pot declarar nul.<br>El treballador es pot negar a fer-ho i denunciar-lo.<br>Podeu acabar pagant una indemnitzaci\u00f3 o haver de tornar enrere.<br>La Inspecci\u00f3 de Treball podria sancionar lactuaci\u00f3.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 heu de fer a la vostra empresa?<\/h2>\n\n\n\n<p>Abans de fer un canvi important com ampliar horaris, canviar torns o afegir caps de setmana:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reviseu si s&#8217;ha consolidat una altra pr\u00e0ctica habitual diferent del contracte.<\/li>\n\n\n\n<li>Consulteu si el conveni col\u00b7lectiu diu alguna cosa sobre la jornada.<\/li>\n\n\n\n<li>Analitzeu si hi ha representants legals amb els quals negociar.<\/li>\n\n\n\n<li>Activeu el procediment de l&#8217;article 41 de l&#8217;Estatut dels Treballadors.<\/li>\n\n\n\n<li>Feu-ho per escrit, amb almenys 15 dies d&#8217;antelaci\u00f3.<\/li>\n\n\n\n<li>Escolteu les al\u00b7legacions dels treballadors i documenteu-ho tot.<\/li>\n<\/ul>\n\n\n\n<p>Comproveu aquests requisits:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>El canvi afecta la jornada, l&#8217;horari o els dies de treball habituals?<\/li>\n\n\n\n<li>Portaven m\u00e9s de 6 mesos aplicant un altre horari diferent del que posa el contracte?<\/li>\n\n\n\n<li>He consultat el conveni col\u00b7lectiu aplicable?<\/li>\n\n\n\n<li>He notificat el canvi amb escrit amb almenys 15 dies d&#8217;antelaci\u00f3?<\/li>\n\n\n\n<li>He seguit el procediment de l&#8217;article 41 de l&#8217;ET?<\/li>\n\n\n\n<li>Tinc justificants i documents de la negociaci\u00f3 o consulta?<\/li>\n\n\n\n<li>He informat els representants dels treballadors, si n&#8217;hi ha?<\/li>\n<\/ol>\n\n\n\n<p>Podeu <a href=\"http:\/\/www.gemap.es\/ca\/contacte\">posar-vos en contacte<\/a> amb aquest despatx professional per a qualsevol dubte o aclariment que pugui tenir al respecte.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Encara que al contracte posi una cosa, si els seus treballadors porten anys amb una altra jornada, no pot canviar-la de cop sense seguir un procediment legal.
