Tot i aix\u00f2, l<strong>a normativa permet modificar la base imposable; si es compleixen certes condicions.<\/strong><\/p>\n\n\n\n<p>Un dels grans dilemes de tot arrendador de locals comercials \u00e9s el seg\u00fcent: qu\u00e8 passa amb l&#8217;IVA quan fa anys que no es cobra un euro de renda i l&#8217;inquil\u00ed ja ni est\u00e0? S&#8217;ha de resignar a perdre all\u00f2 ingressat a Hisenda o pot modificar la base imposable per recuperar aquestes quotes repercutides al seu dia?<\/p>\n\n\n\n<p>La Direcci\u00f3 General de Tributs (en consulta vinculant V0255-25, de 5 de mar\u00e7 de 2025) s&#8217;ha pronunciat sobre aquesta q\u00fcesti\u00f3, i la seva an\u00e0lisi ajuda a aclarir una situaci\u00f3 habitual en temps de morositat i contractes resolts de manera unilateral o for\u00e7osa.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">El cas: tres anys sense cobrar i un contracte que s&#8217;extingeix<\/h2>\n\n\n\n<p><br>En el cas plantejat, l&#8217;empresa \u00e9s arrendadora de diversos locals. Des d&#8217;agost del 2020 fins al juny del 2023, un dels seus llogaters no va abonar cap renda. Finalment, el juny del 2023 es va produir el desallotjament i es va donar per acabat el contracte. Avui dia, el deute s&#8217;ha donat de baixa comptablement com a cr\u00e8dit incobrable i l&#8217;empresa pregunta si pot modificar la base imposable de l&#8217;IVA, d&#8217;acord amb l&#8217;article 80.Dos de la Llei de l&#8217;IVA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Impagament, extinci\u00f3 i rescissi\u00f3: tres figures que no s\u00f3n el mateix<\/h2>\n\n\n\n<p><br>El primer que cal entendre \u00e9s que no tot impagament justifica una modificaci\u00f3 de la base imposable. Segons el criteri reiterat de la DGT, del TEAC i dels tribunals europeus, cal que l&#8217;operaci\u00f3 hagi quedat totalment o parcialment sense efecte. Aix\u00f2 es d\u00f3na, per exemple, quan el contracte es resol, l&#8217;inquil\u00ed marxa i ja no \u00e9s possible exigir el pagament de les quotes pendents.<\/p>\n\n\n\n<p>En canvi, si l&#8217;arrendatari continua ocupant l&#8217;immoble, encara que no pagui, i no hi ha resoluci\u00f3 ferma del contracte, encara no es pot parlar d&#8217;operaci\u00f3 extingida ni de cr\u00e8dit incobrable a efectes de l&#8217;IVA.<\/p>\n\n\n\n<p>La doctrina ho expressa amb claredat: l&#8217;article 80. Dos de la Llei de l&#8217;IVA permet modificar la base imposable si l&#8217;operaci\u00f3 queda sense efecte mitjan\u00e7ant resoluci\u00f3 judicial, administrativa o conforme a dret. I, en aquest cas, s&#8217;ent\u00e9n que la resoluci\u00f3 del contracte per impagament i aband\u00f3 del local compleix aquest requisit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Jurisprud\u00e8ncia europea que canvia lenfocament<\/h2>\n\n\n\n<p><br>El Tribunal de Just\u00edcia de la Uni\u00f3 Europea (TJUE), en sent\u00e8ncies com Lombard (C-404\/16) i UniCredit Leasing (C-242\/18), ha consolidat la idea que quan una operaci\u00f3 s&#8217;extingeix amb car\u00e0cter definitiu, ja no hi ha contraprestaci\u00f3 exigible, i per tant, la base imposable s&#8217;ha d&#8217;ajustar fins i tot si el motiu. No \u00e9s una simple mora, sin\u00f3 una anul\u00b7laci\u00f3 jur\u00eddica i econ\u00f2mica del negoci.<\/p>\n\n\n\n<p>La clau rau en l&#8217;extinci\u00f3 real del cr\u00e8dit, ja sigui per acord, per decisi\u00f3 judicial o per abandonament i baixa comptable. El que no es pot fer \u00e9s esperar indefinidament ni pretendre rectificar quan no hi ha document, fet ni resoluci\u00f3 que evidenci\u00ef que l&#8217;operaci\u00f3 va quedar sense efecte.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I com es rectifica l&#8217;IVA?<\/h2>\n\n\n\n<p>Un cop es compleixen els requisits legals, l&#8217;empresa pot optar per dues vies:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Procediment de rectificaci\u00f3 d&#8217;autoliquidacions (art. 120.3 de la LGT) si es considera que la quota repercutida s&#8217;ha tornat improcedent.<\/li>\n\n\n\n<li>Regularitzaci\u00f3 en el model del per\u00edode actual o seg\u00fcent, sempre dins el termini d&#8217;un any des que es va produir la causa que en permet la rectificaci\u00f3 (art. 89.5 de la Llei de l&#8217;IVA).<\/li>\n<\/ol>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> La factura rectificativa s&#8217;ha d&#8217;emetre com m\u00e9s aviat millor, i la modificaci\u00f3 nom\u00e9s es pot fer si no han passat m\u00e9s de quatre anys des de la meritaci\u00f3 de l&#8217;impost o des que es va produir la causa de la modificaci\u00f3.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quina documentaci\u00f3 exigeix \u200b\u200bHisenda?<\/h2>\n\n\n\n<p>La rectificaci\u00f3 s&#8217;ha de formalitzar mitjan\u00e7ant una factura rectificativa completa, que identifiqui l&#8217;original i que consigni clarament la minoraci\u00f3 de base i impost. A m\u00e9s, cal acreditar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El desallotjament del local<\/li>\n\n\n\n<li>La resoluci\u00f3 del contracte<\/li>\n\n\n\n<li>La baixa comptable del cr\u00e8dit<\/li>\n\n\n\n<li>I, si s&#8217;acudeix al procediment de l&#8217;art. 120.3, la sol\u00b7licitud formal davant de l&#8217;Administraci\u00f3<\/li>\n<\/ul>\n\n\n\n<p><strong>Atenci\u00f3<\/strong>. No n&#8217;hi ha prou amb deixar d&#8217;emetre factures o pensar que el temps ja ha prescrit el deute.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusi\u00f3: s\u00ed, pot recuperar l&#8217;IVA, per\u00f2 faci-ho b\u00e9<\/h2>\n\n\n\n<p>La Llei de l&#8217;IVA permet que l&#8217;arrendador recuperi l&#8217;IVA ingressat quan les rendes meritades s\u00f3n incobrables i el contracte s&#8217;extingeix, per\u00f2 no de qualsevol manera ni en qualsevol moment.
