{"id":5103,"date":"2025-05-05T09:41:16","date_gmt":"2025-05-05T09:41:16","guid":{"rendered":"https:\/\/gemap.es\/?p=5103"},"modified":"2025-05-05T09:41:17","modified_gmt":"2025-05-05T09:41:17","slug":"davant-de-persones-amb-discapacitat-lempresa-ha-dadaptar-abans-dacomiadar","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/davant-de-persones-amb-discapacitat-lempresa-ha-dadaptar-abans-dacomiadar\/","title":{"rendered":"Davant de persones amb discapacitat; l&#8217;empresa ha d&#8217;adaptar abans d&#8217;acomiadar"},"content":{"rendered":"\n<p>Aix\u00ed ho imposa la Llei 2\/2025 sobre <strong>incapacitat permanent.<\/strong><\/p>\n\n\n\n<p>El canvi legal posa en primer pla el <strong>dret a continuar treballant<\/strong>, obligant les empreses a reconsiderar les seves pol\u00edtiques davant de les situacions d&#8217;incapacitat.<\/p>\n\n\n\n<p>El mercat de treball espanyol est\u00e0 a punt de fer un pas crucial en la defensa de la igualtat efectiva.<\/p>\n\n\n\n<p>Al BOE del dia 30 d&#8217;abril, s&#8217;ha publicat la Llei 2\/2025 per la qual es modifica l&#8217;Estatut dels treballadors per <strong>eliminar, de manera definitiva, la possibilitat d&#8217;extingir autom\u00e0ticament el contracte laboral per la declaraci\u00f3 d&#8217;incapacitat permanent total, absoluta o gran incapacitat.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Aquesta norma entrar\u00e0 en vigor el dia 1 de maig de 2025.<\/h2>\n\n\n\n<p><br>Es tracta d&#8217;un canvi de paradigma: la persona treballadora ja no ser\u00e0 expulsada del lloc sense m\u00e9s ni m\u00e9s, sin\u00f3 que ser\u00e0 ella qui decideixi si vol mantenir la seva vinculaci\u00f3 laboral, sol\u00b7licitant l&#8217;adaptaci\u00f3 del seu lloc o un canvi de tasques compatibles.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Aix\u00ed queda el procediment: decisi\u00f3, adaptaci\u00f3 i protecci\u00f3<br><\/h2>\n\n\n\n<p>El procediment previst a la Llei ser\u00e0 el seg\u00fcent:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Declarada la incapacitat permanent<\/strong>, el treballador disposa de <strong>10 dies naturals<\/strong> per manifestar la voluntat de continuar vinculat a l&#8217;empresa.<\/li>\n\n\n\n<li><strong>L&#8217;empresa comptar\u00e0 amb 3 mesos <\/strong>per valorar:\n<ul class=\"wp-block-list\">\n<li>La possibilitat dadaptar el lloc actual.<\/li>\n\n\n\n<li>L&#8217;exist\u00e8ncia dun altre lloc vacant i compatible.<\/li>\n\n\n\n<li>O, si no, justificar que l&#8217;ajust suposaria una c\u00e0rrega excessiva.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>Nom\u00e9s si ladaptaci\u00f3 no \u00e9s possible o resulta excessivament onerosa, i pr\u00e8via motivaci\u00f3 per escrit, lempresa podr\u00e0 extingir el contracte.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qu\u00e8 implica \u00abc\u00e0rrega excessiva\u00bb i com es mesura?<br><\/h2>\n\n\n\n<p>La llei diferencia:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Empreses de fins a 25 treballadors:<\/strong> La c\u00e0rrega es considera excessiva si l&#8217;adaptaci\u00f3 supera l&#8217;import m\u00e9s gran entre sis mesos de salari o la indemnitzaci\u00f3 per acomiadament improcedent.<\/li>\n\n\n\n<li><strong>Empreses m\u00e9s grans<\/strong>: Es valorar\u00e0 la mida de l&#8217;organitzaci\u00f3, els seus recursos econ\u00f2mics i la possibilitat d&#8217;ajudes p\u00fabliques que compensin el cost.<\/li>\n<\/ul>\n\n\n\n<p>No qualsevol dificultat justifica l&#8217;acomiadament: La llei exigeix \u200b\u200buna valoraci\u00f3 seriosa i justificada.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Un canvi impulsat pel dret internacional i europeu<br><\/h4>\n\n\n\n<p>Aquesta reforma no sorgeix de buit. S&#8217;inspira en la Convenci\u00f3 sobre els Drets de les<\/p>\n\n\n\n<p>Persones amb Discapacitat (ONU, 2006) ia la Directiva 2000\/78\/CE de la Uni\u00f3 Europea, que subratllen l&#8217;obligaci\u00f3 de fer ajustaments raonables abans d&#8217;excloure alg\u00fa del mercat laboral.<\/p>\n\n\n\n<p>A nivell nacional, a m\u00e9s, segueix el cam\u00ed marcat per la reforma recent de l&#8217;article 49 de la Constituci\u00f3 Espanyola, que refor\u00e7a la prohibici\u00f3 de discriminaci\u00f3 per motius de discapacitat.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Suspensi\u00f3 de contracte i adaptaci\u00f3: m\u00e9s temps i m\u00e9s protecci\u00f3<br><\/h2>\n\n\n\n<p>En paral\u00b7lel, la Llei modifica tamb\u00e9 el r\u00e8gim de suspensi\u00f3 del contracte. Mentre es tramiten els ajustaments o el canvi de lloc, el treballador mant\u00e9 la suspensi\u00f3 de la relaci\u00f3 laboral amb reserva del lloc fins a un m\u00e0xim de dos anys. Aix\u00f2 suposa un blindatge temporal que protegeix el treballador davant de decisions precipitades o injustes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Impacte per a les empreses: una gesti\u00f3 m\u00e9s exigent per\u00f2 tamb\u00e9 m\u00e9s justa<br><\/h2>\n\n\n\n<p>Les empreses hauran de:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Comptar amb <strong>protocols d&#8217;adaptaci\u00f3<\/strong> de llocs de treball.<\/li>\n\n\n\n<li>Treballar de forma coordinada amb els serveis de prevenci\u00f3 de riscos laborals.<\/li>\n\n\n\n<li>Documentar exhaustivament <strong>les mesures adoptades <\/strong>i justificar degudament qualsevol impossibilitat dadaptaci\u00f3.<\/li>\n<\/ul>\n\n\n\n<p>A m\u00e9s, ser\u00e0 crucial que formin els seus responsables en mat\u00e8ria d&#8217;igualtat d&#8217;oportunitats i ajustaments raonables, evitant aix\u00ed riscos de nul\u00b7litat d&#8217;acomiadaments.<\/p>\n\n\n\n<p><a href=\"http:\/\/www.gemap.cat\/contacte\">Contacti <\/a>amb aquest despatx professional per a qualsevol dubte o aclariment que pugui tenir sobre aix\u00f2.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aix\u00ed ho imposa la Llei 2\/2025 sobre incapacitat permanent.
