{"id":4802,"date":"2025-01-15T08:56:39","date_gmt":"2025-01-15T08:56:39","guid":{"rendered":"https:\/\/gemap.es\/?p=4802"},"modified":"2025-01-15T08:56:40","modified_gmt":"2025-01-15T08:56:40","slug":"2025-porta-canvis-significatius-a-lambit-laboral","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/2025-porta-canvis-significatius-a-lambit-laboral\/","title":{"rendered":"2025 porta canvis significatius a l&#8217;\u00e0mbit laboral"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">El passat 2 de gener del 2025, i amb <strong>entrada en vigor el proper 3 d&#8217;abril del 2025<\/strong>, es va publicar al BOE la Llei Org\u00e0nica 1\/2025 introduint modificacions significatives en mat\u00e8ria laboral i de Seguretat Social.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquestes reformes impacten tant en la gesti\u00f3 judicial com en els drets dels treballadors i les relacions laborals. Us resumim els principals canvis.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Reformes a la Jurisdicci\u00f3 Social<\/strong><br>a) Transformaci\u00f3 de Jutjats Socials a Tribunals d&#8217;Inst\u00e0ncia<br>Se substitueix el model de jutjats unipersonals per tribunals d&#8217;inst\u00e0ncia, organitzats en seccions com la social.<br>b) Impuls de l&#8217;oralitat<br>Es fomenta l&#8217;\u00fas de l&#8217;oralitat en les sent\u00e8ncies, facilitant-ne l&#8217;emissi\u00f3 r\u00e0pida de resolucions i la notificaci\u00f3. Aquest canvi est\u00e0 dissenyat per accelerar els procediments judicials i adaptar-se a les exig\u00e8ncies de la realitat social.<br>c) Actes de conciliaci\u00f3<br>Els lletrats de l&#8217;Administraci\u00f3 de Just\u00edcia poden:<br>Proposar dofici la conciliaci\u00f3 si consideren que les parts poden arribar a un acord.<br>Establir una agenda doble per facilitar els acords previs al judici.<br>Terminis:<br>Les conciliacions s&#8217;han de fer almenys 10 dies despr\u00e9s de l&#8217;admissi\u00f3 de la demanda i amb una antelaci\u00f3 m\u00ednima de 30 dies respecte a la vista.<br>d) Preparaci\u00f3 de la prova<br>Ampliaci\u00f3 del termini per sol\u00b7licitar dilig\u00e8ncies preparat\u00f2ries de proves: de 5 a 10 dies abans de la vista.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Aquest canvi busca garantir que els jutjats disposin de prou temps per gestionar notificacions i proves, especialment documentals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">e) Modificaci\u00f3 del recurs de cassaci\u00f3<br>S&#8217;introdueix el concepte d&#8217;inter\u00e8s casacional objectiu:<br>Aquest criteri promou la uniformitat en la interpretaci\u00f3 de la normativa laboral i garanteix la formaci\u00f3 duna jurisprud\u00e8ncia coherent.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Modificacions a l&#8217;Estatut dels Treballadors (ET)<\/strong><br>a) Extinci\u00f3 per voluntat del treballador (Article 50 ET)<br>Retards salarials:<br>Es considera retard greu si el pagament del salari supera els 15 dies de la data pactada.<br>\u00c9s causa d&#8217;extinci\u00f3 justificada si:<br>Es deuen 3 mensualitats completes en un any, encara que no siguin consecutives.<br>Hi ha retards al pagament durant 6 mesos no consecutius.<br>b) Protecci\u00f3 de treballadors en permisos (Articles 53.4.b i 55.5.b ET)<br>S&#8217;amplia la nul\u00b7litat d&#8217;extincions:<br>Acomiadaments o extincions que afectin treballadors que:<br>Hagen sol\u00b7licitat o gaudeixin de permisos per cura de familiars (art. 37.3.b ET).<br>Hagen sol\u00b7licitat adaptacions de jornada (art. 34.8 ET).<\/li>\n\n\n\n<li><strong>Indemnitzacions per acomiadament<\/strong><br>S&#8217;aclareix que les indemnitzacions per acomiadament o cessament no estan exemptes d&#8217;IRPF si deriven de pactes, convenis o contractes privats.<br>No obstant aix\u00f2, les indemnitzacions acordades davant d&#8217;un servei administratiu com a pas previ a la via judicial s\u00ed que es podran beneficiar de l&#8217;exempci\u00f3 fiscal, garantint m\u00e9s seguretat jur\u00eddica.<\/li>\n\n\n\n<li><strong>Foment de la mediaci\u00f3 i resoluci\u00f3 de conflictes<\/strong><br>Tot i que les mat\u00e8ries laborals estan excloses dels mitjans alternatius que regula aquesta llei, es fomenta l&#8217;\u00fas de mecanismes com la negociaci\u00f3 assistida i la mediaci\u00f3 en el marc de la seva normativa espec\u00edfica.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Aix\u00f2 busca reduir la c\u00e0rrega judicial i promoure solucions pactades entre les parts.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Noves funcions a la Inspecci\u00f3 de Treball<\/strong><br>Els inspectors de treball poden participar en activitats relacionades amb conflictes laborals, sempre que no siguin permanents, i estiguin vinculades a sistemes aut\u00f2noms de resoluci\u00f3 de conflictes.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Aquestes activitats queden exceptuades del r\u00e8gim general d\u00bfincompatibilitats per a funcionaris p\u00fablics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Podeu posar-vos en contacte amb aquest despatx professional per a qualsevol dubte o aclariment que pugueu tenir al respecte.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>El passat 2 de gener del 2025, i amb entrada en vigor el proper 3 d&#8217;abril del 2025, es va publicar al BOE la Llei Org\u00e0nica 1\/2025 introduint modificacions significatives en mat\u00e8ria laboral i de Seguretat Social.
