{"id":4758,"date":"2024-12-30T10:23:34","date_gmt":"2024-12-30T10:23:34","guid":{"rendered":"https:\/\/gemap.es\/?p=4758"},"modified":"2024-12-30T10:23:35","modified_gmt":"2024-12-30T10:23:35","slug":"videovigilancia-a-lempresa-i-drets-del-treballador","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/videovigilancia-a-lempresa-i-drets-del-treballador\/","title":{"rendered":"Videovigil\u00e0ncia a l&#8217;empresa i drets del treballador"},"content":{"rendered":"\n<p>La implementaci\u00f3 de <strong>c\u00e0meres de videovigil\u00e0ncia a l&#8217;entorn laboral <\/strong>desperta debats inevitables.<\/p>\n\n\n\n<p>Ens trobem davant d&#8217;un equilibri delicat entre el dret de l&#8217;ocupador a supervisar les tasques dels seus treballadors i la protecci\u00f3 de la intimitat personal, un principi innegociable garantit constitucionalment.<\/p>\n\n\n\n<p>La videovigil\u00e0ncia laboral \u00e9s una eina poderosa, per\u00f2 s&#8217;ha de fer servir amb prud\u00e8ncia i respecte als drets fonamentals. El principi de proporcionalitat en guia la validesa:<\/p>\n\n\n\n<p>\u00b7 Hi ha d&#8217;haver una finalitat clara i justificada.<br>\u00b7 Les c\u00e0meres no poden envair \u00e0rees privades o de descans.<br>\u00b7 La seva instal\u00b7laci\u00f3 i abast han de ser comunicats als treballadors, llevat d&#8217;excepcions concretes.<br><\/p>\n\n\n\n<p>Els tribunals han marcat els l\u00edmits: la vigil\u00e0ncia desproporcionada o invasiva s&#8217;invalida, fins i tot quan els enregistraments proven fets irregulars. La clau rau a equilibrar el control empresarial amb el respecte a la intimitat i dignitat dels empleats.<\/p>\n\n\n\n<p>Per tant, la videovigil\u00e0ncia laboral \u00e9s un tema delicat que enfronta dos drets en conflicte aparent: el dret de l&#8217;ocupador a supervisar el compliment laboral i protegir els seus b\u00e9ns, i el dret a la intimitat i privadesa dels treballadors. La normativa espanyola, juntament amb la jurisprud\u00e8ncia nacional i internacional, ha anat marcant l\u00edmits clars per al seu \u00fas i assenyalant les excepcions en qu\u00e8 es pot justificar.<\/p>\n\n\n\n<p>A continuaci\u00f3, analitzarem els <strong>criteris legals<\/strong> per instal\u00b7lar sistemes de videovigil\u00e0ncia, les excepcions m\u00e9s rellevants i les darreres sent\u00e8ncies que han tingut precedents.<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Instal\u00b7laci\u00f3 de c\u00e0meres: obligacions i l\u00edmits<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Segons la Llei Org\u00e0nica 3\/2018 (LOPDGDD), qualsevol sistema de videovigil\u00e0ncia ha de complir els requisits seg\u00fcents:<\/p>\n\n\n\n<p>\u00b7 <strong>Informaci\u00f3 pr\u00e8via:<\/strong> L&#8217;empresa ha d&#8217;informar els treballadors i, si escau, els seus representants, de manera expressa, clara i concisa sobre l&#8217;exist\u00e8ncia de c\u00e0meres.<br>\u00b7 <strong>Proporcionalitat:<\/strong> La mesura ha de ser adequada i necess\u00e0ria, respectant el principi de proporcionalitat.<br>\u00b7 <strong>\u00c0rees sensibles:<\/strong> Les c\u00e0meres no s&#8217;han d&#8217;instal\u00b7lar a vestidors, lavabos, menjadors o altres espais destinats al descans o privadesa.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Videovigil\u00e0ncia desproporcionada: un \u00fas abusiu<\/strong><\/li>\n<\/ol>\n\n\n\n<p>El TSJ de Castella-la Manxa (02-11-2023) ofereix un exemple clau de vigil\u00e0ncia desmesurada. Tot i que les c\u00e0meres no gravaven \u00e0rees privades, capturaven zones sensibles com taquilles, accessos a banys i menjadors. A m\u00e9s, el control realitzat era excessiu, en supervisar detalladament els moviments i gestos dels empleats.<\/p>\n\n\n\n<p>Per al Tribunal, la videovigil\u00e0ncia va vulnerar el dret a la intimitat per la seva <strong>intensitat desproporcionada<\/strong>, obligant l&#8217;empresa a retirar les c\u00e0meres ia indemnitzar els treballadors.<\/p>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> El control empresarial no pot excedir els l\u00edmits raonables; fins i tot una instal\u00b7laci\u00f3 legal es pot invalidar si el seu \u00fas resulta abusiu.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Videovigil\u00e0ncia durant el descans: una excepci\u00f3 v\u00e0lida<\/strong><\/li>\n<\/ol>\n\n\n\n<p>El Tribunal Suprem (TS 13-10-2021) va considerar procedent l&#8217;acomiadament d&#8217;un conductor que, durant el descans, va fumar a l&#8217;autob\u00fas, va orinar a l&#8217;exterior i va interactuar de manera indeguda amb una passatgera. Les raons de validesa van ser aquestes:<\/p>\n\n\n\n<p>\u00b7 La <strong>finalitat <\/strong>de les c\u00e0meres era garantir la seguretat del vehicle i les persones.<br>\u00b7 Els treballadors estaven <strong>informats<\/strong> de la seua exist\u00e8ncia mitjan\u00e7ant distintius visibles.<br>\u00b7 No es requeria consentiment del treballador en tractar-se de <strong>mesures de seguretat<\/strong>.<br><strong>Atenci\u00f3.<\/strong> La vigil\u00e0ncia amb fins de seguretat en per\u00edodes de descans \u00e9s v\u00e0lida si respecta els l\u00edmits i la proporcionalitat.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Cambres ocultes: quan s\u00f3n legals<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Tot i que la norma general exigeix \u200b\u200binformar de la instal\u00b7laci\u00f3 de c\u00e0meres, hi ha excepcions en casos d&#8217;irregularitats greus. Aquestes situacions han de complir dos requisits:<\/p>\n\n\n\n<p>\u00b7 <strong>Sospites fundades:<\/strong> Hi ha d&#8217;haver una justificaci\u00f3 raonable que s&#8217;estan cometent actes il\u00b7l\u00edcits.<br>\u00b7 <strong>Mesura necess\u00e0ria:<\/strong> No hi ha d&#8217;haver altres alternatives menys intrusives.<br><strong>Exemple<\/strong>. Una fam\u00edlia va instal\u00b7lar una c\u00e0mera oculta al seu domicili despr\u00e9s de patir robatoris per valor de 30.000 euros. Les imatges van captar la seva empleada de llar manipulant la caixa forta, cosa que va permetre justificar-ne l&#8217;acomiadament. La mesura va ser considerada proporcionada i necess\u00e0ria.<\/p>\n\n\n\n<p>La instal\u00b7laci\u00f3 de c\u00e0meres ocultes \u00e9s v\u00e0lida quan hi ha una necessitat justificada i no hi ha mitjans menys invasius per verificar els fets.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>L&#8217;enregistrament d&#8217;\u00e0udio: un l\u00edmit infranquejable<\/strong><\/li>\n<\/ol>\n\n\n\n<p>El TSJ de Burgos (02-05-2024) va declarar nul\u00b7la l&#8217;enregistrament d&#8217;una treballadora que havia com\u00e8s un furt. Tot i que la instal\u00b7laci\u00f3 de c\u00e0meres de videovigil\u00e0ncia era v\u00e0lida, l&#8217;enregistrament inclo\u00efa \u00e0udio, un aspecte que no va ser informat.<\/p>\n\n\n\n<p>Per al Tribunal, l&#8217;enregistrament de sons requereix consentiment previ dels treballadors, excepte en casos excepcionals relacionats amb la seguretat.<\/p>\n\n\n\n<p><strong>Atenci\u00f3.<\/strong> L&#8217;enregistrament d&#8217;\u00e0udio \u00e9s m\u00e9s intrusiu que la videovigil\u00e0ncia i requereix un grau m\u00e9s alt de justificaci\u00f3 i transpar\u00e8ncia.<\/p>\n\n\n\n<ol start=\"6\" class=\"wp-block-list\">\n<li><strong>Cambres a vestidors i zones de descans: un terreny prohibit<\/strong><\/li>\n<\/ol>\n\n\n\n<p>El TSJ de Catalunya (29-06-2023) va resoldre el cas d&#8217;una treballadora comiat despr\u00e9s de ser gravada orinant en recipients de cuina a l&#8217;obrador. La zona servia tamb\u00e9 com a vestidor, i per aix\u00f2 el tribunal va declarar improcedent l&#8217;acomiadament.<\/p>\n\n\n\n<p>Per al Tribunal, la videovigil\u00e0ncia en <strong>\u00e0rees de privadesa<\/strong> (vestuaris o zones de descans) est\u00e0 prohibida, fins i tot quan hi hagi una finalitat disciplin\u00e0ria.<\/p>\n\n\n\n<p><strong>Atenci\u00f3. <\/strong>Les c\u00e0meres no s&#8217;han de col\u00b7locar en espais que comprometin la intimitat personal, per molt justificada que sigui la mesura.<br>En definitiva, la videovigil\u00e0ncia a nivell laboral \u00e9s una eina v\u00e0lida, per\u00f2 el seu \u00fas s&#8217;ha d&#8217;ajustar estrictament a la legalitat i respectar els drets fonamentals dels treballadors.<\/p>\n\n\n\n<p>\u00b7 La <strong>informaci\u00f3 pr\u00e8via <\/strong>i el principi de proporcionalitat s\u00f3n requisits indispensables.<br>\u00b7 Les <strong>c\u00e0meres ocultes s\u00f3n excepcionals<\/strong> i nom\u00e9s es justifiquen davant de sospites fundades i la inexist\u00e8ncia d&#8217;alternatives menys invasives.<br>\u00b7 La <strong>gravaci\u00f3 d&#8217;audio<\/strong> requereix consentiment expl\u00edcit.<br>\u00b7 Els <strong>espais privats<\/strong> com vestuaris, lavabos o zones de descans s\u00f3n fora dels l\u00edmits permesos.<br>El desafiament per a les empreses \u00e9s protegir els seus interessos sense vulnerar la dignitat i privadesa dels treballadors.
