{"id":4116,"date":"2024-11-25T14:45:30","date_gmt":"2024-11-25T14:45:30","guid":{"rendered":"https:\/\/gemap.es\/precisio-en-el-periode-de-prova-per-evitar-acomiadaments-improcedents\/"},"modified":"2024-12-05T13:13:17","modified_gmt":"2024-12-05T13:13:17","slug":"precisio-en-el-periode-de-prova-per-evitar-acomiadaments-improcedents","status":"publish","type":"post","link":"https:\/\/gemap.es\/ca\/precisio-en-el-periode-de-prova-per-evitar-acomiadaments-improcedents\/","title":{"rendered":"Precisi\u00f3 en el per\u00edode de prova per evitar acomiadaments improcedents"},"content":{"rendered":"\n<p><strong>Sense durada exacta per escrit, el Tribunal Suprem considera improcedent l&#8217;acomiadament en per\u00edode de prova.<\/strong><\/p>\n\n<p>Volem informar-vos sobre una recent sent\u00e8ncia del Tribunal Suprem de 24 de setembre de 2024, que pot afectar la vostra empresa en temes de contractaci\u00f3.<\/p>\n\n<div style=\"height:24px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">La Sent\u00e8ncia<\/h3>\n\n<p>La sent\u00e8ncia aclareix que, si al contracte de treball no s&#8217;especifica clarament la durada exacta del per\u00edode de prova, qualsevol cessament en aquest per\u00edode pot ser considerat un acomiadament improcedent.<\/p>\n\n<p>\u00c9s important que els contractes dels seus empleats incloguin aquesta informaci\u00f3 de manera precisa per evitar possibles reclamacions.<\/p>\n\n<p>En concret, en relaci\u00f3 amb aquesta sent\u00e8ncia, \u00e9s fonamental revisar alguns punts cr\u00edtics sobre la regulaci\u00f3 del per\u00edode de prova en contractes laborals, especialment a l&#8217;\u00e0mbit de la Seguretat Privada.<\/p>\n\n<p>Aquesta resoluci\u00f3 aborda un cas d&#8217;acomiadament improcedent, on es va q\u00fcestionar la validesa del per\u00edode de prova a causa d&#8217;una ambig\u00fcitat a la durada establerta. El contracte del treballador en q\u00fcesti\u00f3 nom\u00e9s indicava &#8220;segons conveni&#8221; com a durada del per\u00edode de prova, la qual cosa va generar una falta de precisi\u00f3 jur\u00eddica sobre la data exacta de finalitzaci\u00f3. <\/p>\n\n<div style=\"height:24px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\">Punts principals de la sent\u00e8ncia<\/h3>\n\n<ol class=\"wp-block-list\">\n<li><strong>Fixaci\u00f3 del per\u00edode de prova:<\/strong> La normativa sectorial a Seguretat Privada estableix una durada m\u00e0xima de dos mesos per al personal operatiu, sense concretar una durada exacta. Aquesta ambig\u00fcitat en el contracte del treballador afectat va resultar en una inseguretat jur\u00eddica, ja que no calia en quin moment conclo\u00efa el per\u00edode de prova. <\/li>\n\n\n\n<li><strong>Dret a la concreci\u00f3 per escrit: <\/strong>L&#8217;article 14 de l&#8217;Estatut dels Treballadors (ET) i la jurisprud\u00e8ncia vigent exigeixen que el per\u00edode de prova estiga clarament especificat en els termes del contracte. No n&#8217;hi ha prou de referir-se gen\u00e8ricament a la durada m\u00e0xima permesa pel conveni col\u00b7lectiu; \u00e9s essencial establir la durada exacta per evitar possibles conflictes i protegir els drets del treballador. <\/li>\n\n\n\n<li><strong>Conseq\u00fc\u00e8ncies de la manca de precisi\u00f3:<\/strong> L&#8217;abs\u00e8ncia d&#8217;una durada concreta al contracte va derivar en la nul\u00b7litat del per\u00edode de prova. Aquesta manca de validesa va implicar que el cessament del treballador fos considerat un acomiadament improcedent.
